An appeals court ruling keeps them in place through July. “What good is a refund of the tariffs paid to a business that is bankrupt and no longer exists?” asks a lawyer for the businesses that sued.

THE TRADE WARS

An appeals court keeps Trump’s tariffs in place: “A federal appeals court on Tuesday granted the Trump administration’s request to keep the president’s far-reaching tariffs in effect for now but agreed to fast track its consideration of the case this summer. The U.S. Court of Appeals for the Federal Circuit extended its earlier temporary pause of a trade court decision that found Trump exceeded his powers in imposing the tariffs. The appeals court said it intends to hear arguments on July 31, which means the tariffs likely will remain in effect for at least the next two months.”

  • “Late last month, the U.S. Court of International Trade, which has national jurisdiction over trade disputes, halted the tariffs, siding with five small businesses and a group of Democratic state attorneys general who challenged Trump’s actions. Jeffrey Schwab, a lawyer for the Liberty Justice Center, the libertarian legal group representing the five businesses, said they were disappointed with the appeals court’s order but appreciated that the Federal Circuit agreed to hear the case on an expedited schedule.”

  • “‘It’s important to note that every court to rule on the merits so far has found these tariffs unlawful, and we have faith that this court will likewise see what is plain as day: that IEEPA does not allow the president to impose whatever tax he wants whenever he wants,’ he said in a statement.”

  • “The plaintiffs had warned the appeals court that allowing the tariffs to stay in effect while their case proceeds would be a death blow for some companies, even if they ultimately prevailed in court and were refunded the levies. ‘What good is a refund of the tariffs paid to a business that is bankrupt and no longer exists?’ they said in a court filing.”
